Gibraltar and Spain agree open border

Treaty dividend crosses final frontier - 27th July 2026

A landmark treaty's brought down the final frontier fence in western Europe, which had stood dividing Spain from the narrow peninsula of Gibraltar since 1908. Four years in the making, the agreement creates a fluid border between the EU's Schengen zone and the 6.8-square-kilometre British Overseas Territory.

The treaty eliminates external border protocols, enforced post-Brexit, at the EU's frontier with Gibraltar, a port and naval base at the mouth of the Mediterranean. These had severely impacted the economy and livelihoods of people in the region following the UK's withdrawal from the EU. They affected the 15,000 frontier workers who commute into Gibraltar daily, the territory's 40,000 residents and the 12 million tourists that arrive annually.

Whenever diplomatic tensions flared during negotiations, Spanish border police tightened all controls, creating queues of one to seven hours. This severely impacted frontier workers, lost revenue for Andalusia's border region, where unemployment averages 30 percent, and caused labour and product shortages in Gibraltar.

The new treaty, negotiated by the EU, Gibraltar, Spain and the UK, creates a customs union between the EU and Gibraltar, which becomes a Schengen entry point. Spanish officials at Gibraltar's port and airport exercise Schengen powers and perform customs controls on goods. It also harmonises local tax, employment and environmental regulations without affecting Gibraltar's British sovereignty.

Spain's prime minister, Pedro Sánchez, spoke at the ceremony to remove the final piece of the fence. He declared "a new era of coexistence and shared prosperity" which was "full of opportunities for the 300,000 Andalusians living in the Campo de Gibraltar."

The agreement incorporates guarantees around future economic development and regularises the legal status of frontier workers. It equalises cross-border workers employment rights and social benefits and protects their UK state pension entitlements. A social fund, financed by the UK and the EU, will provide training and employment opportunities for young people to help reduce regional inequalities.

Disputes over Gibraltar's sovereignty date back to the Treaty of Utrecht 1713, which ceded the territory to the British Crown. While Spain's position remains unchanged, Sánchez believes "politics achieves its greatest dignity when it stops managing inherited problems and finds the courage to resolve them".
